The most common discharge violations include creditors who continue to report balances owed on consumer credit reports which constitutes an attempt to collect a debt and  also violate the FDCPA and FCRA laws. Debt buyers may acquire and then attempt to collect on discharged debts  or wrongfully commence foreclosure on property to collect debts whose security was stripped during bankruptcy. Other violations include creditors or collectors who continue to ding consumer’s credit reports with impermissible pulls / accessing debtor’s consumer reports after discharge. Once the debt is discharged the consumers’ permission granting access to his consumer reports no longer applies, i.e. for obtaining credit purpose. Discharged debtors should retrieve their consumer reports annually to confirm their discharge is being honored.
