Telephone Consumer Protection Act (TCPA)
STOP ROBOCALLS
Who Can I Sue For Robo Calls to My Phones?
We handle lawsuits on behalf of consumers who received unwanted calls from debt collectors, banks and other companies on their cell phones which violate the Telephone Consumer Protection Act (TCPA) – 47 U.S.C. § 227.
The TCPA is one of the most popular Federal consumer laws of all time. Its purpose is to protect our right to privacy. This law allows “we the people” to choose how, when and by what means we are contacted by telemarketers and debt collectors. Congress found that unwanted automated calls were a “nuisance and an invasion of privacy, regardless of the type of call.” Banning such calls was “the only effective means of protecting telephone consumers from this nuisance and privacy invasion.”
The purpose of the TCPA is to reduce the number of nuisance calls. The following statement was made part of the congressional record back in 1991. The situation is not much different even though it’s more than 25 years later.
“Computer telephone calls are invading our homes and destroying our privacy. Consumers around the country are crying out for Congress to put a stop to these computerized telephone calls. Congress has a clear opportunity to protect the interests of our citizens, and we should not pass up this chance.
Computerized telephone calls are the scourge of modern civilization. They wake us up in the morning; they interrupt our dinner at night; they force the sick and elderly out of bed; they hound us until we want to rip the telephone right out of the wall. These machines are out of control, and their use is growing by 30% every year. It is telephone terrorism, and it has got to stop”.

If you received unwanted calls to your cell phone, we may be able to help stop the calls and collect penalty damages designed to make the violators think twice about robo dialing consumers. We help people who are wrongly called by companies looking for a different person. We also represent consumers who continue to be contacted after requesting that a company stop calling.
Consumers may be able to file lawsuits against the following types of institutions for placing robocalls:
If you have questions about your rights under the TCPA, feel free to contact my office. We would only take a case such as this on a contingency basis. That means that we would only be paid out of any money that we recover for you. So, if we don’t recover anything, then you wouldn’t owe us anything. So if you are experiencing unwanted robo calls and want more information on how to make it stop.
